By using this website, and registering in the Modatex Portal, you agree to the collection and processing of your information as set out in this Privacy Policy.

About this Privacy Policy

MODATEX respects your preferences about the processing of your Personal Data.

«Personal Data» concern information relating to an identified or identifiable natural person ("Data Subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

This Privacy Policy lets you know how MODATEX collects and uses your Personal Data, how you can control its use, and describes our practices regarding information collected on other websites that link to or reference this Policy (such as websites, software applications, social media and electronic messaging) as well as offline marketing and sales activities (collectively, "Communication Channels”).

The Communication Channels may provide links to other platforms that do not belong to MODATEX and are managed by third party entities. We therefore encourage you to check the general conditions of use and privacy policies of those websites, services, social networks or applications before providing your Personal Data, as this privacy policy only applies to this website. MODATEX does not take responsibility for those websites, services, social networks ou applications managed by third parties to which hyperlinks from our communication channels may refer.

 

What information do we collect about you?

The user may browse and access the MODATEX website without this necessarily implying the provision of personal data.

However, the website offers functionalities and services that MODATEX cannot make available without having access to some personal data of the user.

As such, MODATEX collects information from the data owner when they register and browse the Modatex website and Portal; when they enter, disclose or update their personal data; when they submit an application; when they register for a training course or event; when they subscribe to the newsletter or other identifiable notifications; when they voluntarily fill in questionnaires, use conversation tools, offer opinions, reply to requests or ask for help; or when they contact MODATEX through the contacts and forms that are available on the website and Modatex Portal.

The data collected and processed are those necessary for the purpose for which you contacted us, and may include data such as your name, telephone number, e-mail address, date of birth, tax number, identification document (number and validity), number of the Certificate of Pedagogical Competencies, what led to your contact, the training areas/training activities you are applying for, and your curriculum vitae among others.

By providing that information you are you are giving your informed and unequivocal consent to the automated processing of your data, as well as authorising the collection, use and disclosure of that data in accordance with the rules set out herein.

We ask you not to send or share with MODATEX any sensitive personal information such as racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, as well as genetic data, biometric data, data concerning health or data concerning sex life or sexual orientation.

Some of the data requested is compulsory and must be identified, and the lack or inaccuracy of the answers given may compromise the service provided.

Website usage information is collected by the use of cookies, but does not specifically identify you, and the following data is or may be collected:

  • IP address.
  • Geographical location.
  • Information about the device that is accessing the website, namely, the type and version of browser, operating system, screen resolution, preferred language, information contained in the HTTP headers and agent version.
  • The search engine you used to locate and access the website.
  • Date and time of activity on the website, as well as web pages and content visited and clicked on.

It is important to emphasise that this usage information does not deliberately identify you and if exceptionally it does, it will be anonymised immediately.

 

How do we use information about you?

The data collected and processed are those necessary for the purpose for which you contacted us, to provide the services requested / contracted, to manage your requests and, whenever requested, to send you newsletters and information about other products, services, events, projects and training offers, which we believe are or will be of interest to you, by email, sms, mms, or any other communication channel.

We use the information collected from the website to personalise your next visits.

We may also, with your consent, send your personal information to partner organisations so that they can offer you their products, services and updated information.

MODATEX does not share your information for marketing campaigns with companies outside MODATEX nor does it transfer your Personal Data to a third country.

Although the information provided is generally treated as private in MODATEX, the data collected will be used in compliance with the General Regulation on the Protection of Personal Data throughout the treatment process; however, it may be necessary to transfer Personal Data privately to other bodies, in particular the judiciary, and in processing your request we may send your data to, and also use information from credit and fraud prevention agencies.

You have the right to file a complaint with a European Union supervisory authority regarding the protection of your Personal Data. MODATEX will co-operate with the Supervisory Authority by providing all the information that it may request in the exercise of its competences.

The information collected on this website does not involve automated decision making, including profiling.

This website does not make comparisons, interconnections or any other form of interconnecting the registered information.

Since your data may circulate on an open network, it risks being seen and used by unauthorised third parties.

MODATEX does not assume any responsibility when, for external or unknown reasons, error, damage, diffusion or unauthorised access resulting from the electronic data transmission that may occur between MODATEX and the Data Controller occurs.

MODATEX only accepts registrations, applications, enrolments and requests for information from users with, at least, 16 years of age, or represented by their legal guardians. MODATEX Communication Channels are not aimed at underage users. If you are aware of any registration submitted by a minor, please notify us so that we can immediately remove the record we hold on them.

The recipients or categories of recipients of your Personal Data are the various Local Units of MODATEX, duly authorised and identified for that purpose.

We share your personal data with your consent or as necessary to complete any transaction or provide any service you have requested/we have been contracted for. We also share data with affiliates controlled by MODATEX and subsidiaries; with partners that work on our behalf; when required by law or to respond to legal processes; to protect our clients; to protect lives; to maintain the safety of our services; and to protect MODATEX’s rights and property.

 

Marketing

We would like to be able to send you information with your consent about MODATEX’s products and services that may already be or may become of interest to you, namely information about training sessions, events, projects, news and up to date information on MODATEX’s activity.

You have the right to remove your consent to be contacted for marketing campaigns at any time. In order to do that, you should contact MODATEX through the postal address Rua Professor Augusto Nobre 483, 4150-119 Porto, or via e-mail at dpo.mx@modatex.pt.

By subscribing the MODATEX newsletter, through the subscription form available on the website, or directly in the user area in the MODATEX Portal, you consent to receive our newsletters, which main objective is to send MODATEX’s news, information, publications and promotions of services and products. This subscription is voluntary and may be cancelled at any time.

MODATEX’s newsletters may, for statistical purposes, contain a single "pixel" that allows to know if they are opened and to check the click through links within each newsletter.

The user can always cancel the subscription to the newsletter by clicking on the cancellation menu in each newsletter; or by the option of notification management in the user area or the MODATEX portal.

 

Access and reliability of your information

We want to be sure of the correctness and reliability of the information we have on you.

We trust the User to give us precise and thorough information and to update your data about any change that may have occurred.

 

Users’ rights and data retention timeframes

The User has the right to withdraw their consent for the processing of personal data concerning them at any time, without undermining the lawfulness of the processing based on the consent previously given. You can also ask MODATEX access to your Personal Data, its correction or deletion as well as the limitation of all information that concerns the User. You can also object to the processing, exercise the right to data portability and request a copy of the information we have about you. You can request a partial or an integral copy of the information retained about you by MODATEX, as well as exercise any other of your rights, by post at Rua Professor Augusto Nobre 483, 4150-119 Porto, or via e-mail at dpo.mx@modatex.pt.

The Personal Data necessary for the execution of the contract in which the User is a party, for the fulfilment of the legal obligations to which the Person Responsible for the Treatment is subject and those that are necessary for the effect of the legitimate interests pursued by MODATEX are not included in the previous point.

If the User’s requests are manifestly unfounded or excessive, especially due to their repetitive nature, under the legal framework in force MODATEX may demand the payment of a reasonable fee to cover the administrative costs of providing the information or communication, or of taking the requested measures, or it may refuse to comply with the request.

Without prejudice to legal or regulatory provisions to the contrary, Personal Data will only be kept for the minimum period necessary for the purposes that motivated their collection or their subsequent processing after which they are eliminated or, if it is of MODATEX’s interest, processed for statistical purposes, anonymized, so that it is not possible to identify their Owner.

Further processing of Personal Data for a purpose other than that for which the data was collected requires the consent of the user. Prior to such processing, the Responsible for the Treatment shall provide the Data Owner with information on that purpose and any other relevant information.

 

Cookies

Small text files stored on your computer which function is to collect information about your device and information about your user’s experience. This information is used to register the number of visits made and gather statistical data about the website’s activity.

Types of Cookies according to the entity that manages them:

MODATEX applies appropriate technical and organisational measures to ensure a level of security appropriate to the risk, by keeping Personal Data on file and during its transmission.

MODATEX has a computer system capable of resisting, with a given level of confidence, accidental events or malicious or illicit actions that compromise the availability, authenticity, integrity and confidentiality of the Personal Data stored or transmitted, as well as the security of the related services offered by or accessible through these networks and systems.
